The Finance Ministry's notification concerning the interpretation of
the law states that foreign nationals who "work in an office in Japan
" or  "have been in Japan for more than six months"  are regarded as
" residents."  Such foreign nationals do not need to apply for approv-
al to acquire* military-related technology.

 　この法律解釈に関する財務省の通達は 「日本国内で業務に
携わる外国国籍の者、もしくは半年以上日本にいる者」は「居住
者」であるとしている．
 　
For example, foreign researchers employed byJapanese universities and
foreign stuidents who have been in Japan for more than six months are
categorized as residents.   They are still prohibited from acts  such as
taking technology out of the country,  but it is difficult for the govern-
ment to keep track of * the situation and ensure the effectiveness of regu-
lation

例えば、日本の大学で雇用されている外国人研究員と日本に半年
以上いる外国人留学生は居住者に分類されている． この人たちの
技術の国外持ち出しなどの行為は依然、禁じられているのだが、
政府が遵守状況を見守ることや、規則の効果性を確実にするとい
うことは至難の業だ．

  " This has been a loophole *  in measures to prevent the outflow of
technology,"  a senior official of the Cabinet Secretariat said.

 「これはこの技術流出を防ぐはずの措置法には抜け穴になって
いました．」と内閣官房古参の高官が言う．


  The government is therefore considering issuing a new notice
regarding the requirements for treating foreign nationals as resi-
dents under the law.  According to the sources, the notice is
likely to state that if there is anything suspicious about foreign
nationals to whom the technology is to be provided, they will
not be recognized as residents and be required to apply  for ap-
proval for the provision.

 政府はこうしたことで、現行法の下で外国国籍の人が
居住者として扱われるための必要条件を織り込んだ新しい
通達を出すことを検討している． 政府筋によると、新しい
通達では技術知識の供給を受ける外国国籍の者は、疑わしい
行為があれば、居住者と認めず、供給承認を申請すること
が求められることになる．
